Information clause on the processing of Personal Data

In accordance with Article 13(1) of Regulation on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC
(hereinafter referred to as the GDPR), we shall inform you that:

II. Purposes and grounds of processing operations

Your personal data shall be processed on the basis of Article 6(1) of the GDPR to enable you to conclude a contract with Termo Profil sp. z o.o. for the products or services offered by Termo Profil sp. z o.o. as well as to fulfil by Termo Profil sp. z o.o its legal obligations, detection and prevention of frauds, establishment, defence and pursue of claims, direct marketing, preparation of reports, analyses and statistics, verification of payment standing, handling of complaints, technical assistance, financial settlements, including issuance of accounting documents.

Termo Profil sp. z o.o. shall be entitled to transfer your personal data to third parties for the purpose and to the extent required for the proper performance of the agreement concluded by you.

V. Data transfers to third countries or international organisations

We shall not transfer your data beyond the territory of Poland/the EU/the EEA.

VI. Data retention period


Your personal data shall be stored for the duration of the agreement concluded by you with Termo Profil sp. z o.o. in relation to which your personal data is processed and upon this period until the date of expiry of the limitation period for claims under the agreement concluded by you. However, your personal data recorded in the accounting records shall be stored for the period indicated in the applicable provisions of law, including tax regulations.

VII. Your individual rights:

You shall be entitled to:

a) access your data and receive copies thereof,

b) rectify (correct) your data,

c) delete your data.

If, in your opinion, there are no grounds for us to process your data, you are entitled to request that we remove it.

d) limit the processing of your data

You are entitled to request that we limit the processing of your personal data (only to storage operations or to other operations agreed with you) if - in your opinion - we hold your incorrect dataor we process it unjustifiably or you do not want it to be deleted because you need it to establish, pursue or defend any claims; or for as long as you object to the processing of your data.

e) object to the processing of your data

"Marketing" objection.

You shall be entitled to object to the processing of your data when used for direct marketing. We will then stop processing your data for this purpose.

Objection due to extraordinary circumstances.

You shall be also entitled to object to the processing of your data on the basis of legitimate interest for purposes other than direct marketing or where such processing is required to conduct tasks performed in the public interest or to exercise public authority vested in us. You should then indicate any extraordinary circumstances which justify the discontinuation of our processing being under your objection. We will stop processing your data unless we can prove that the grounds on which we process the data take precedence over your rights or that your data is necessary for us to establish, pursue or defend any claims.

f) transfer your data:

You shall be also entitled to have your data transferred by us directly to another entity.

g) lodge a complaint with the supervisory authority

If you consider that we process your data unlawfully, you shall be entitled to lodge a complaint about it with the President of the Office for the Protection of Personal Data or another competent supervisory authority.

h) withdraw your consent to the processing of personal data

At any time, you shall be entitled to withdraw your consent to the processing of personal data that we process on the basis of your consent. The withdrawal of consent shall not affect the lawfulness of processing operations conducted on the basis of your consent prior to the withdrawal.

VIII. Information on the requirement/voluntary provision of data

The provision of data by you shall be voluntary.

IX. Information on the data source

We have obtained your data directly from you.

X. Information on profiling and automated processing

Your data shall be neither processed automatically nor profiled.
